Terms & Conditions
1. Who we are
BackHome ("BackHome", "we", "us", "our") is a consulting business operated by BackHome OÜ, a company registered in Estonia. You can contact us at hi@backhome.life.
BackHome helps individuals living abroad, anywhere in the world, obtain guidance and arrange for services they need in their home country by connecting them with independent, verified experts and service partners ("Partners") located in that country.
2. What these Terms cover
These Terms & Conditions ("Terms") govern your access to and use of the BackHome website, application, and services (together, the "Platform"). By creating an account, accepting these Terms at sign-up, or placing an order, you agree to be bound by them. If you do not agree, do not use the Platform.
These Terms are accepted electronically at account sign-up. A record of each acceptance — the user, the date and time, and the version of the Terms accepted — is stored by BackHome.
3. The most important things to understand
Please read this section carefully. The rest of these Terms build on it.
3.1 BackHome provides consulting — that is what you pay us for
The fee you pay to BackHome is a consulting fee. It pays for BackHome's advisory and facilitation services: understanding what you need, advising you, and — where relevant — identifying and introducing you to a suitable verified Partner. Your payment to BackHome is for this consulting and facilitation, and not for the underlying service that a Partner may perform for you.
3.2 BackHome is an introducer, not the service provider
Where BackHome connects you with a Partner, BackHome is making an introduction only. The Partner is an independent third party. BackHome does not perform the Partner's services, does not supervise or control how the Partner works, and is not a party to any agreement you may enter into with a Partner.
Any service a Partner performs for you is a matter between you and the Partner. You are responsible for agreeing the terms of that service directly with the Partner, for satisfying yourself as to the Partner's suitability, and for taking whatever steps, precautions, checks, and arrangements are necessary to protect your own interests. BackHome gives no warranty or guarantee about any Partner or about the outcome, quality, safety, legality, or timeliness of any service a Partner performs, and accepts no obligation or liability in respect of it. "Verified" means only that BackHome has carried out its own reasonable checks on a Partner; it is not a guarantee of any kind.
3.3 BackHome is not a bank or financial services provider
BackHome is not a bank, and is not a payment institution, money services business, money transmitter, e-money issuer, or financial services provider of any kind. BackHome does not provide banking, money transfer, remittance, currency-exchange, custody, escrow, or investment services, and does not hold or transmit your money as a financial service.
Payments on the Platform are processed by a third-party payment provider, Finoment LLC, acting as Merchant of Record. Your payment relationship for the processing of transactions is with that provider and is subject to its terms.
4. Eligibility and your account
To use the Platform you must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate, current, and complete information when you register and to keep it up to date. You are responsible for keeping your account credentials secure and for activity that takes place under your account.
5. Sanctions, legality, and your representations
BackHome operates across borders and takes legal and sanctions compliance seriously. By using the Platform, you represent, warrant, and agree, each time you use it, that:
- you are not a person or entity that is the target of, or owned or controlled by a person or entity that is the target of, sanctions administered or enforced by any relevant authority, including the United States (OFAC), Canada (including under SEMA), the European Union, the United Nations, or the United Kingdom (each a "Sanctions Authority"), and you are not located, organised, or resident in a country or territory that is itself the target of comprehensive sanctions;
- you are not acting on behalf of, or for the benefit of, any such sanctioned person, entity, or territory;
- the funds you use on the Platform are your own or lawfully available to you, come from a legitimate source, and are not the proceeds of any unlawful activity;
- your use of the Platform, and the services you are requesting, are lawful in your own jurisdiction and in the jurisdiction where the service is to be performed; and
- you will not use the Platform for any unlawful, fraudulent, or sanctioned purpose.
BackHome may refuse, suspend, delay, or cancel any request, and may suspend or close your account, where it considers this necessary to comply with sanctions or other laws, or where any of the above ceases to be true.
6. How BackHome works — orders and consulting
- You submit a request describing what you need.
- BackHome reviews the request, provides consulting and advice, and where appropriate identifies and introduces a suitable Partner.
- The consulting fee, and what it includes, is shown to you before you pay. By placing an order you agree to that fee.
- Once introduced, any engagement of the Partner and any additional costs are arranged directly between you and the Partner, unless expressly stated otherwise.
7. Fees and payment
Fees are stated on the Platform and are payable in advance unless stated otherwise. Payment is collected by the Merchant of Record / payment provider (see section 3.3). You agree to pay all fees for orders you place.
8. Refunds and cancellations
- Before a request is processed: you may cancel a request that has not yet been processed and receive a refund of the consulting fee. If any unavoidable cost has already been incurred in processing a refund or the request, that cost may be deducted from the amount refunded.
- After services have been delivered: once the consulting and/or the introduction has been delivered, the fee is non-refundable, except where you raise a dispute through BackHome's dispute process (section 9) and that dispute is decided in your favour.
- Nothing in this section limits any non-waivable statutory rights you may have as a consumer under applicable law.
9. Disputes with BackHome
If you are dissatisfied with the consulting BackHome provided, you may raise a dispute with BackHome by contacting us at hi@backhome.life within a reasonable period of the relevant order. You should describe the issue and provide any relevant information. BackHome will review the dispute in good faith and notify you of the outcome. Where a dispute is decided in your favour, BackHome may, at its discretion and depending on the circumstances, provide a full or partial refund of the consulting fee or another appropriate remedy.
This internal process concerns your relationship with BackHome and the consulting it provided. Disputes about a Partner's service are between you and the Partner (see section 3.2).
10. Your responsibilities and acceptable use
You agree not to misuse the Platform. In particular you agree not to: use it unlawfully or for any sanctioned or fraudulent purpose; provide false information; impersonate anyone; interfere with or attempt to compromise the Platform's security; or use it to transmit unlawful, harmful, or infringing content. You are responsible for your dealings with Partners.
11. Limitation of liability
To the fullest extent permitted by law:
- BackHome's services are provided on a consulting and facilitation basis, and BackHome does not warrant any particular result.
- BackHome is not liable for the acts, omissions, conduct, or services of any Partner, or for any loss arising out of your engagement with a Partner (see section 3.2).
- BackHome is not liable for indirect, incidental, special, or consequential losses.
- To the extent BackHome is found liable to you despite the above, its total aggregate liability is limited to the amount of the consulting fee(s) you paid to BackHome for the order giving rise to the claim.
12. Privacy
BackHome processes personal data in accordance with its Privacy Policy, which forms part of these Terms.
13. Changes to these Terms
BackHome may update these Terms from time to time. When it does, it will publish the updated version with a new version number and effective date, and — where the change is material — take reasonable steps to notify you and, where appropriate, ask you to accept the updated Terms. Each version, and your acceptance of it, is recorded.
14. Suspension and termination
BackHome may suspend or terminate your access where you breach these Terms, where required for legal or sanctions compliance, or where it reasonably needs to. You may stop using the Platform at any time.
15. Governing law and jurisdiction
These Terms are governed by the laws of Estonia, without regard to conflict-of-laws rules. The courts of Estonia have jurisdiction over any dispute arising out of or in connection with these Terms, subject to any mandatory consumer-protection rights that apply in your country of residence.
16. General
- Entire agreement: these Terms, together with the Privacy Policy and any order-specific terms, are the entire agreement between you and BackHome.
- Severability: if any provision is found unenforceable, the rest remains in effect.
- No waiver: a failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign your rights under these Terms without BackHome's consent; BackHome may assign its rights as permitted by law.
